Update: Harish Salve fees in the Kulbhushan Jadhav case

Harish Salve has charged a token fee of Rs. 1 for defending Kulbhushan Jadhav before the International Court of Justice.

This was revealed by Sushma Swaraj, the Minister of External Affairs.

Education and Early life

Harish Salve comes from a family of illustrious lawyers. His grandfather was a very successful criminal lawyer. His father, N. K. P. Salve, was an eminent Chartered Accountant practicing in Nagpur. His mother was also a professional, a doctor.

From a young age, Harish Salve was fascinated by professional qualities & values & how they always fought for principles and issues.

When Salve was a young boy, he wanted to be an engineer. However, by the time he was ready for college, he was deeply interested in Chartered Accountancy.

He joined his father’s practice of accountancy and income-tax matters.

Meeting Nani Palhivala

The turning point in Harish Salve’s life came when he met Nani Palkhivala, the legendary lawyer.

Harish Salve learnt the nuances of advocacy under Nani Palhivala. He assisted Palkhivala as a junior in the famous Minerva Mills case and other important cases.

The extensive grounding that he received from Nani Palkhivala helped Harish Salve cement his position in the profession.

Chambers of Soli Sorabjee

Harish Salve joined the Chambers of Soli Sorabjee, also a leading constitutional lawyer, as a junior.

This exposed Harish Salve to commercial matters involving large stakes. He argued a large number of important matters as a junior counsel of Soli Sorabjee.

One of the important matters that Harish Salve handled as a junior counsel was the Bearer Bonds case (R. K. Garg vs. UOI 133 ITR 239). He argued the entire matter before a five-judge constitution Bench in 1981.

Appointment as Solicitor General

Harish Salve was appointed Solicitor General in November 1999 when he was only 43 years of age. He held office till 2002.

The appointment as the premier law officer for the Union of India, exposed Harish Salve to a large number of important matters.

He argued important matters for the Government such as the first anti-dumping case, the first case of privatization of PSUs etc.

He was also instrumental in doing important non-litigation work such as conducting the WTO negotiations, drafting the electricity reforms and setting up legislation for the competition commission.

These aspects gave Harish Salve a larger perspective to legal matters and helped him develop his arguing skills.

Expert in tax and corporate law

Harish Salve’s education as a CA gave him an edge over other lawyers in the Supreme Court.

He was one of the few lawyers of stature practicing income-tax law in the Supreme Court. This attracted him to large MNCs and foreign companies who were looking for good lawyers to assist them.

Salve has appeared in a large number of income-tax matters such as UCO Bank vs. CIT 237 ITR 889 (SC), CIT vs. Podar Cement 226 ITR 625 (SC), Azadi Bachao Andolan 263 ITR 706 (SC), GE India Technology vs. CIT 327 ITR 456 (SC), Ishikawajima-Harima Heavy Industries vs. DIT 288 ITR 408 (SC) etc.

He also appeared in complex corporate law matters such as the one between Mukesh Ambani and Anil Ambani relating to RIL and RNRL.

Role Model: Nani Palkhivala

Harish Salve has stated that Nani Plakhivala is his idol and role model.

He paid tribute to Palkhivala by saying:

From him I learnt that genius is a lot of hard work. It entails having the capacity to do what people find boring, that is where you hone your attention to detail. Palkhivala taught me to make excellence an end unto itself. He used to say that the measure of how well you’ve argued in court comes not from the decision of the court, but from how you personally feel you’ve performed. He opened up a whole new dimension of the world before me.

Attitude of hard work

Harish Salve believes in the credo that hard work has to precede brilliance. He believes in the necessity for full research into all case laws.

He also makes it a point to do only a few matters at a time so that he can concentrate on them.

I attend court daily to hear the other side’s arguments. I don’t like to distract myself and prefer to concentrate on the case at hand. You never know when a new idea pops up,” he said.

Fees

Harish Salve also follows the custom of charging a retainer fee and an appearance fee. The retainer fee is to ensure that he does not accept the brief of, or advice, the opposite party. This depends on the stakes involved in the fee. The retainer fee can be as much as Rs. 1 crore in large matters.

The appearance fee for a SLP admission or opposition ranges from Rs. 3 lakh to Rs. 5 lakh. The appearance fee for a full day hearing can range from Rs. 10 lakh to Rs. 15 lakh depending on the complexity of the matter and the extent of argument required to be made.

The fees charged by Harish Salve in the Vodafone income-tax matter and also in the Mukesh Ambani – Anil Ambani dispute were close to Rs. 15 crore. However, these were exceptional matters where the hearings went on for days on end and cannot be treated as representative of the fees generally charged by Harish Salve.

Income

Harish Salve has been one of the largest income-tax payers in the Country for a long time.

Important information about the income of Harish Salve is available for the income-tax case that he fought against the Income-tax department before the Tax Tribunal.

The name of the case is HARISH NARINDER SALVE vs. ACIT I.T.A. No. 100/Del/2015 for Assessment Year: 2010-11 dated 21.09.2017.

It is recorded in the order that Harish Salve filed his return of income for the assessment year in dispute on 14.10.2010 declaring total income of Rs. 34,74,20,950/-. He also filed his revised return of income on 31.3.2012 declaring total income of Rs. 34,94,15,822/- and AO completed the assessment u/s. 143(3) of the Act on 08.1.2013 at the
total income of Rs. 35,10,91,350/- by making the addition of
Rs.11,40,000/- on account of depreciation allowance for the first half
added back on Bentley Car offered and added to the computation of
income to avoid litigation.

If in AY 2010-11, Harish Salve had an income of Rs. 35 crore, it is safe to estimate that his present annual income before tax is in the range of Rs. 60 to Rs. 70 crore.

Net worth

Harish Salve’s Net Worth is estimated to be close to Rs. 200 crore.

His education as a Chartered Accountant means that he is well versed with the best investment avenues, namely stocks.

Meenakshi Salve, Harish Salve’s wife, is an artist. She is a stained glass designer. She is also an art collector and has a keen eye for picking up rare items of art.

Chamber/ House / Bungalow

Harish Salve’s residence is located at 42, Poorvi Marg, Vasant Vihar, New Delhi.

His chamber or office is also located here.

The house was built by N.K.P. Salve, Harish’s father. Harish moved into the house in 1982, after his marriage to Meenakshi.

The house has five bedrooms. It is built on an 800-sq yd plot and has a built-up area of 6,000 square feet across three levels.

Harish Salve’s chamber or office is in the basement of the bungalow.

The ground floor has two bedrooms, the kitchen, a dining room and the living room.

There is a staircase that leads to the first floor. The first floor has three bedrooms.

There are a number of art items in the house which have been personally picked by Meenakshi, Sakshi and Saaniya.

Some of the art items include a Buddha statue in dark wood and a sculpture of St. Peter. There is also a crystal chandelier at the entrance.

There is marble flooring throughout. The furniture is teak wood. There are heavy drapes on the windows.

There is also a large collection of crystal, glassware and silverware that the Harish and Meenakshi have gathered during their trips abroad.

Sakshi Harish Salve

Sakshi Salve, Daughter

Sakshi Salve, Harish Salve’s daughter, is an accomplished author.

She has written a book titled “The Big Indian Wedding, The Ultimate Guide for Dummies”.

The book is a satirical account by Sakshi Salve of the excesses of modern-day Indian weddings and highlights why weddings are a serious yet crazy business in India.

The book was promoted by several eminent personalities including Salman Khan.

Saaniya Salve Siddiqui, daughter

Saaniya Salve, Harish’s other daughter, is a biologist. She did her schooling from Modern School, Vasant Vihar, and then studied Biology at Boston University.

She is also a translator and specializes in Spanish and Italian translations into English.

Armaan Siddiqui is Saaniya Salve’s husband. The couple married in March 2014 in a ceremony held in Goa.

The multi-religious wedding ceremony of Saaniya and Armaan Siddiqui and the resultant festivities were held in Vijay Mallya’s bungalow villa in Candolim at Goa.

Saaniya and Armaan Siddiqui are both foodies and enjoy cooking and eating exotic food items.

Internship

Harish Salve offers internship to law students under the rules of the Bar Council of India.

The internship program is for four weeks, six days in a week.

The timings of the Chamber are from 9.00 am to 7.00 pm.

The intern is entitled to attend conferences that are occasionally held on Sundays and public holidays.

No stipend is payable to the intern for the internship.

Defense of Kulbhushan Jadhav

Harish Salve has won praise from the public for his defense of Kulbhushan Jadhav before the International Court of Justice.

Kulbhushan Jadhav has been found guilty by a kangaroo court set up by Pakistan, the terrorist State, and sentenced to hanging on charges of spying.

The trial of Kulbhushan Jadhav has been conducted by Pakistan in secrecy and nobody knows what evidence was considered before arriving at the decision to execute Kulbhushan Jadhav.

Harish Salve has successfully argued before the International Court of Justice that Kulbhushan Jadhav is innocent.

Based on this, the ICJ has passed an order directing Pakistan to stay all proceedings and not take further steps.

Harish Salve’s professionalism in the matter has won him praise from eminent citizens like Suhel Seth, Javed Akhtar, Sushil Kedia and others.

Criticism of Justice Markandey Katju

Harish Salve has always been critical of Justice Markandey Katju, the eccentric retired judge of the Supreme Court.

He had earlier written an article in which he said:

Justice Markandey Katju was always “different”. Sobriety and discretion were as alien to him as vegetarianism to a leopard. Blogger Katju continues in the same vein. This time, he has created seismic reverberations in our hallowed community of black robes.

Later, when Katju tweeted that “I regard Shazia Ilmi much more beautiful than Kiran Bedi. If Shazia had been made their C.M. candidate BJP wud have definitely won the Delhi … People vote for beautiful faces, as in Croatia. Even a person like me who does not vote wud have voted for Shazia”, Harish Salve criticized Katju and said that the manner of appointment of judges has to change.

Threat over Padmavaat

Harish Salve was threatened by the Karni Sena due to his appearing in the Supreme Court for Sanjay Leela Bhansali to oppose the ban over Padmaavat movie. The Police have filed a FIR in the matter and provided protection to the Senior Advocate.
